Terms of Use (EULA)
Last updated: January 27, 2025
Agreement to Terms
These terms constitute the End User License Agreement ("EULA") for the DevBrief app. By accessing or using DevBrief's AI news digest and ML news digest app on iOS (Apple App Store) or Android (Google Play Store), you agree to be bound by these Terms of Use.
Use of Service
DevBrief provides curated AI news and personalized AI news for personal, non-commercial use. You may not use our service for any illegal or unauthorized purpose.
User Conduct
You agree to use DevBrief only for lawful purposes and in accordance with these Terms. You may not:
- Use the service in any way that violates applicable laws, regulations, or third-party rights
- Circumvent, disable, or interfere with security-related features, access controls, or usage limits
- Copy, scrape, redistribute, or create derivative works from our content or service without permission
- Use automated systems (e.g., bots, scrapers) to access the service except as we explicitly permit
- Impersonate any person or entity, or misrepresent your affiliation
- Transmit malware, spam, or any harmful or disruptive content
- Use the service to harass, abuse, or harm others
We reserve the right to suspend or terminate your access if we determine, in our sole discretion, that you have violated these conduct rules or any applicable law.
Detailed Subscription Terms
DevBrief offers a free tier with basic features that you can use forever without any payment. We also offer an optional premium subscription. By subscribing to DevBrief Premium, you agree to the terms below. See our pricing page for current offers.
Subscription Name and Length
- Subscription title: DevBrief Premium
- Length: Monthly or annually, as selected at purchase. Monthly subscriptions recur each month; annual subscriptions recur each year.
- Price: Pricing is displayed in the app at purchase. As of the last update of these Terms, DevBrief Premium is offered at approximately $4.99/month (monthly) or $39.99/year (annual). Prices may vary by region and platform; the amount charged is shown before you confirm.
Auto-Renewal and When You Are Charged
Premium subscriptions are sold as in-app purchases on iOS (Apple App Store) and Android (Google Play Store). Payment is charged to your Apple ID or Google account at confirmation of purchase. Subscriptions automatically renew at the end of each billing period unless you turn off auto-renewal at least 24 hours before the end of the current period. You will be charged for each renewal at the then-current price for your plan until you cancel.
How to cancel: You can manage or cancel your subscription in your device settings. On iOS: Settings → Apple ID → Subscriptions → DevBrief → Cancel Subscription. On Android: Google Play Store → Subscriptions → DevBrief → Cancel subscription. Cancellation takes effect at the end of the current billing period; you retain access until then.
Free Trial
DevBrief Premium is offered as an in-app subscription (via Apple App Store or Google Play). The subscription includes a 7-day free trial (introductory offer). If you start a subscription, you will not be charged until the trial ends. When the trial ends, you will be charged for the subscription unless you cancel before the trial period ends. Any unused portion of a free trial is forfeited when you purchase a subscription. Trial eligibility may vary and is determined by the store (Apple or Google).
Cancellation Policy
You may cancel your subscription at any time through your device settings as described above. Cancellation stops future charges. You will not receive a refund for the unused portion of the current billing period. We do not provide refunds for partial months or years.
Refund Policy
All purchases are generally non-refundable. Refund requests for subscriptions made through the Apple App Store or Google Play Store must be submitted to Apple or Google in accordance with their respective refund policies. We cannot process refunds for in-app purchases directly; contact Apple or Google support for eligible refunds.
Account Deletion
You may delete your DevBrief account at any time. For full details on what data is removed and alternatives, see our Delete Account page.
How to Delete Your Account
From the app (recommended): In the DevBrief app, open Settings (profile/settings tab), scroll to the bottom, and tap Delete Account. Confirm when prompted; your account and associated data are then permanently deleted. No email is required.
By email: If you cannot access the app, send an email to [email protected] with the subject "Delete Account," your account email, and confirmation that you wish to delete. We will process your request within 30 days.
What Happens to Your Data
Upon account deletion, we permanently delete your account information, reading history, bookmarks, preferences, comments, and related data (as described on our Delete Account page). We may retain transaction records and anonymized data where required by law or for legitimate business purposes, as set out in our Privacy Policy.
Subscriptions and Account Deletion
Deleting your account does not automatically cancel a DevBrief Premium subscription billed through the Apple App Store or Google Play Store. To stop future charges, you must cancel your subscription in your device settings (iOS: Settings → Apple ID → Subscriptions; Android: Google Play Store → Subscriptions) before or after deleting your account. We do not refund any unused portion of a subscription. Cancelling your subscription in device settings does not delete your account; use the in-app Delete Account flow or contact support if you also want your account removed.
Intellectual Property
All content provided through DevBrief, including AI news filtering and curation, is protected by intellectual property laws.
Termination of Service
We may suspend or terminate your access to DevBrief, in whole or in part, at any time and for any reason, including but not limited to: (a) violation of these Terms or our User Conduct rules; (b) fraudulent, abusive, or illegal activity; (c) extended inactivity; (d) requests by law enforcement or regulatory authorities; (e) discontinuation or material modification of the service; or (f) any other reason we deem necessary to protect our users, the service, or third parties.
Upon termination, your right to use DevBrief ceases immediately. We may delete your account and associated data in accordance with our data retention practices. Provisions of these Terms that by their nature should survive termination (including Intellectual Property, Limitation of Liability, Dispute Resolution, and Governing Law) will survive.
You may terminate your access at any time by deleting your account as described in the Account Deletion section. If you have a subscription, cancel it via your device settings to avoid further charges.
Modifications to Service
We may change, suspend, or discontinue any part of DevBrief (including features, content, availability, or pricing) at any time. We may also impose new limits, conditions, or fees. We will use reasonable efforts to notify you of material changes (e.g., via in-app notice, email, or a notice on our website), but we are not obligated to do so for every change.
If we make material changes to these Terms, we will update the "Last updated" date and, where appropriate, provide additional notice. Your continued use of DevBrief after changes become effective constitutes acceptance of the revised Terms. If you do not agree, you must stop using the service and may delete your account. For subscription changes (e.g., price increases), we will give you advance notice where required by applicable law or platform rules (e.g., App Store or Google Play).
Limitation of Liability
DevBrief is provided "as is" without warranties. We are not liable for any damages arising from your use of our AI news digest service.
Dispute Resolution and Governing Law
Informal resolution: Before filing a formal dispute, you agree to contact us at [email protected] and attempt to resolve the dispute informally. We will try to resolve it in good faith within 30 days.
Arbitration: If we cannot resolve the dispute informally, you and DevBrief agree that any dispute, claim, or controversy arising out of or relating to these Terms or the service shall be resolved by binding arbitration, rather than in court, except that either party may seek equitable relief in court for infringement or misuse of intellectual property rights. The arbitration shall be administered by a recognized arbitration provider (e.g., JAMS or AAA) under its applicable rules. The arbitrator's decision will be final and binding. You agree to waive any right to a jury trial or to participate in a class action.
Governing law: These Terms and any dispute arising therefrom shall be governed by and construed in accordance with the laws of the United States and the State of Delaware, without regard to conflict-of-law principles. The United Nations Convention on Contracts for the International Sale of Goods does not apply.
Exceptions: Some jurisdictions do not permit certain arbitration or class-action waivers. If you are in such a jurisdiction, those provisions may not apply to you, and you may have additional rights. Nothing in these Terms affects your statutory rights as a consumer where applicable law requires.
